www.fizzwhizzdesigns.com is a site operated by Monique Green trading as Fizz Whizz Designs ("we" or “us”).

1. INTRODUCTION      

Please read this refund policy carefully before placing an order. By purchasing services and/or products on this site, you agree to be bound by this refund policy. If you are not willing to be bound by this refund policy, please do not purchase products from this site or from another associated site.

2. VARIATIONS

We may revise these terms of use at any time by amending this page or by provisions or notices published elsewhere on our site.

3. ACCEPTANCE OF ORDER

3.1 These Terms will become binding on you and us, and a Contract will come into effect between you and us only upon our written acceptance of the order issued to you by email (Email Confirmation) or when we contact you to tell you that we are able to provide the services or products to you. We are not bound by the order unless we accept it in writing.

3.2 The contract confirmation will be provided within a reasonable time after the conclusion of the contract, but in any event not later than the delivery time of any goods supplied under the contract.

3.3 For the purposes of Paragraph 3.2, the confirmation is treated as being provided as soon as the trader has sent it or done what is necessary to make it available to the consumer.

3.4 If there is any conflict between these Terms and any term of the order, the order will take priority.

4. RIGHT TO CANCEL

4.1 Your legal right to cancel a Contract starts from the date on which you receive the Email Confirmation. Your right to cancel the Contract depends on what you have ordered and how it is delivered. 

4.2 In relation to digital content not on a tangible medium, you may cancel the Contract at any time up to 14 days after the day on which the Contract is entered into without giving any reason, and without incurring any liability except where the consumer requests early supply of service.

4.3 Notwithstanding Clause 4.2, you agree that we may begin the supply of digital content not on a tangible medium before the end of the cancellation period set out in Clause 4.2 and therefore acknowledge that you will lose your cancellation rights. 

4.4 When purchasing digital products from us, you are required to give your prior express consent to begin the early supply of the digital content not on a tangible medium before the end of the cancellation period stated in Paragraph 4.2.

4.5 You are also required to acknowledge at the point of purchase, that on the date on which you receive the Email Confirmation, and the Contract starts, you cease to have the legal right to cancel the Contract as the supply of the digital content has begun.

4.6 By purchasing digital products on this site or another associated site, you agree to be bound by these terms. If you are not willing to be bound by these terms, please do not purchase products on this site, or on another associated site.

4.7 As a consumer, you have legal rights in relation to Products that are faulty, defective or not as described. See Clause 5 for information on defective products. These legal rights are not affected by your right of return and refund in Clause 4 or anything else in these Terms. You can seek advice on your legal rights from your local Citizens' Advice Bureau or Trading Standards Office.

5. IF THERE IS A PROBLEM WITH OUR DIGITAL PRODUCTS

In the unlikely event that there is any defect with our products:

(a) please contact us and tell us as soon as reasonably possible

(b) please give us a reasonable opportunity to replace any defective product; and

(c) we will make every effort to replace any defective product within 7 days.

If under these circumstances a replacement product is not able to be given, any refunds issued will be at the sole discretion of Fizz Whizz Designs.

6. JURISDICTION AND APPLICABLE LAW

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site(s).

These terms of use and any dispute or claim arising out of, or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

7. DECLARATION

As the owner and proprietor of Fizz Whizz Designs, I, Monique Green, confirm that, to the best of my ability, I have defined my products as truthfully and factually correct, according to the matters referred to in Part 2, Regulation 5(4) and (5) of The Consumer Protection from Unfair Trading Regulations 2008. (https://www.legislation.gov.uk/uksi/2008/1277/part/2), and have given the consumer the information listed in Schedule 2 (https://www.legislation.gov.uk/uksi/2013/3134/schedules/made) in a clear and comprehensible manner, as per 10(1)(a) (https://www.legislation.gov.uk/uksi/2013/3134/regulation/10/made).

I do not, in any way, wish to deceive the average consumer in relation to any of the matters referred to in Part 2 Regulation 5(4) and (5) of The Consumer Protection from Unfair Trading Regulations 2008 (https://www.legislation.gov.uk/uksi/2008/1277/part/2), or cause the average consumer to take a transactional decision he would not have taken otherwise, due to aspirational or false information regarding my products.
